 sor\, FRSN\n\nDiscussion\n\nMany Australians sense that liberty is shrinki
 ng. Governments of all political persuasions have legislated in the name o
 f safety\, security\, public health\, equality and the public good. Each n
 ew law\, regulation and administrative apparatus reduces the sphere of ind
 ividual freedom\, raising a broader question: what institution remains cap
 able of limiting government power?\nSome argue Australia needs a constitut
 ional Bill of Rights\, with courts acting as the ultimate arbiters of cons
 titutional boundaries. Others contend that Australia's freedoms have long 
 rested upon a different foundation: responsible government\, the Crown-in-
 Parliament\, common law principles\, constitutional conventions\, democrat
 ic accountability\, and a tradition of residual liberty in which governmen
 t must justify interference with the people\, not the other way around.\nT
 his forum explores two competing constitutional traditions.\nIs freedom be
 st protected through enumerated rights enforced by courts\, or through Wes
 tminster constitutional tradition that presumes liberty and constrains aut
 hority?\nOr does the problem lie\, not in the absence of rights\, but in a
  diminishing understanding of the constitutional foundations that once con
 strained power?\nIf Australians believe liberty is diminishing\, what is t
 he cause? What\, if anything\, should be done about it?\n\nImportant Infor
